What you’ll be doing
In further development of its Global IP Function, the Hitachi Group has created a key role for a Vice President responsible for Brand Enforcement and Trademark Strategy and Portfolio Development to support Hitachi Group.
This new position will afford the right candidate the opportunity to participate in an exciting period of growth for the company through IP leadership and support in the globalization of the Company’s activities in particular in the area of Social Innovation. This role will be important to the development and advancement of the Hitachi IP organization globally and will serve as an important partner and contributor to the growth of the Hitachi Group and development and protection of the Hitachi Brand.
Reporting directly to the CIPO and working closely with Hitachi Corporate (Global Marketing & Brand organizations) as well as group businesses, the ideal candidate must have experience in working with Marketing and Branding functions to advise on development of a global trademark and brand portfolio, as well as brand protection and enforcement.
In collaboration with other Group IP Departments, primary responsibilities of this role are directed to developing the trademark and brand support activity through business engagement, and further developing the global IP function, including by defining Group IP Policy and Standards.
What you bring to the team
We’re looking for a team player, who is independent minded motivated by delivering great work in support of the Hitachi vision.
The candidate must feel comfortable in taking an active role in engaging senior levels of the various businesses to provide relevant advice in a technology-oriented multinational, in particular with regard to software and solutions offerings. Domain knowledge in the areas of trademarks and internet presence is a must.
This role will include among other things:
- Collaborating in a cross-functional setting to achieve defined objectives to provide and expand IP support including working with the Group Legal Departments and Group and Business Functions of Marketing and Branding;
- Advising on trademark and brand related matters in business (situational and transactional) and litigation/pre-litigation contexts;
- Advising on, drafting, negotiating and managing IP specific agreements including licenses, third party technology developments, and non-disclosure agreements;
- Management of outside attorneys for trademark and brand related matters;
- Providing other assistance and support to the group companies and functions, and Legal department as requested;
- Advising on brand related aspects of M&A deals;
- Contributing to developing Global IP Strategy including policies and procedures.
More specifically, in this role you will:
- Conduct/supervise trademark clearance and prosecution, including review of packaging and advertising, and giving infringement risk-management advice
- Train and advise marketing clients on current trademark, copyright and social media issues
- Draft, negotiate, and advise clients on trademark license and coexistence agreements
- Police trademark and copyright infringement activities by third parties
- Assist in setting case strategy and manage outside counsel in trademark oppositions and litigations
- Advise and support Global Brand Group and Group businesses as to brand migration strategy & development, and co-branding initiatives
- Advise clients and conduct trademark and copyright due diligence for acquisitions/divestitures
- Travel as required to represent the interests of Hitachi Group and group companies
Qualifications/Requirements:
- Trademark professional with a minimum of 15 years professional experience at a corporate IP department in the areas of trademark and copyrights, including trademark clearance and prosecution, advising on and negotiating coexistence and license agreements, and counseling on digital domain presence.
- Intellectual property pre-litigation and litigation experience
- Expert knowledge of relevant IP laws, rules, regulations and practice and familiarity with the relevant counterpart systems (e.g., US, EU).
- Proven ability to quickly identify, prioritize and analyze issues, to create solutions, to communicate in a counseling role, and to work effectively and team with all levels of business management as well as with members of the IP and legal departments.
- Strong ability to be an advisor to the group businesses through clear communication skills- written and oral.
- Demonstrated ability to work with and manage outside counsels.
- Experience working in a global IP environment.
- Fluency in English required, working knowledge of a second language a plus.
- Experience in managing and working with large international trademark portfolios
- Excellent business judgment with the ability to make decisions and give advice that demonstrates an understanding of overall business objectives and the risk/reward of each situation
- Maturity and strong leadership skills, with the ability to articulate positions and provide direction
- A commitment to the highest professional and ethical standards
- Strong executive “presence” and the ability to quickly gain the confidence of clients, enhanced by a strong sense of teamwork and outstanding people skills
- A high level of energy and self-motivation

For residents of New York City, California State only, as required under applicable pay transparency laws, the expected salary range for this position if filled remotely is $225,386 – $281,732. Pay is determined based on a variety of factors including, but not limited to, depth of experience in the practice area. Employees are eligible to participate in Hitachi America’s variable pay program, subject to the program’s conditions and restrictions.
